Terms of Service

1. Acceptance of Terms

By accessing or using Wastegate ("the Service"), operated by Wastegate Technologies, LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Wastegate is an AI-powered aircraft maintenance management platform that provides maintenance case tracking, work order management, AI-assisted diagnostics grounded in maintenance manuals, airworthiness directive tracking, and compliance tools. The Service is designed to assist qualified maintenance personnel and does not replace the judgment of certified mechanics, inspectors, or other authorized personnel.

3. Important Disclaimer - Not a Substitute for Professional Judgment

THE SERVICE IS AN ASSISTIVE TOOL ONLY. All maintenance decisions, sign-offs, and return-to-service determinations must be made by appropriately certificated personnel in accordance with 14 CFR Part 43 and applicable regulations. AI-generated responses are based on indexed maintenance manuals and should always be verified against the current, official version of the applicable manual or regulation. We do not guarantee the accuracy, completeness, or currency of AI-generated information.

4. User Accounts and Organizations

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Organization administrators are responsible for managing user access, roles, and permissions within their organization. You must provide accurate information when creating an account and keep it up to date.

5. Subscription and Billing

Paid plans are billed monthly. All plans include a 14-day free trial. You may cancel at any time from the Billing page or Stripe customer portal. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months. We reserve the right to change pricing with 30 days notice.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service or other users' data
• Upload malicious files or content
• Share your account credentials with unauthorized persons
• Use the Service to make maintenance decisions beyond your certificate authority
• Reverse engineer, decompile, or disassemble any part of the Service

7. Data and Content

You retain ownership of all data you upload to the Service, including maintenance manuals, aircraft records, and case notes. We do not claim ownership of your content. You grant us a limited license to process, store, and index your content solely to provide the Service. We may use anonymized, aggregated usage data to improve the Service.

8. Audit Trail Integrity

The Service maintains an immutable audit log of all maintenance actions. Audit log records cannot be modified or deleted by any user, including administrators. This is by design to support FAA compliance requirements under AC 120-78A.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WASTEGATE TECHNOLOGIES, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Termination

We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately. You may request an export of your data within 30 days of termination.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
